Purchasing Terms and Conditions

1. Ordering

  • When you have completed your order, an order confirmation will be sent to your email address. In the confirmation you will find all the information about products, price, invoicing address and delivery address.

  • If there is any error in the order confirmation, you should immediately contact us by email at order@daylight.se.

2. Delivery

  • Our normal delivery times are 1-4 days. Please note: Orders placed at weekends are dispatched no earlier than the following Monday.

  • If the delivery is delayed (and we have not informed you of a longer delivery time), please contact us at: order@daylight.se.

3. Prices

  • All prices in the shop are quoted in SEK and include 25% VAT.

  • We reserve the right to make price changes caused by price changes from suppliers, misprints in the price list and errors in prices due to incorrect information, and reserve the right to adjust the price.

4. Right of withdrawal

  • When purchasing goods on the website, you as a customer have a statutory 14-day right of withdrawal that applies from the time you have received an item that you have ordered. 

4.1 When exercising your right of withdrawal:

  • You must notify us that you have changed your mind. The message should be sent to us at order@daylight.se. Your message should clearly indicate your name, address, email address, order number and the products to which the return relates.

  • You should return the products to us immediately and no later than within the statutory period of 14 days after the message notifying us that you are exercising your right of withdrawal.

  • You are responsible for return shipping, delivery and the condition of the products when they are returned. The products should therefore be sent well packaged and in their original packaging.

  • We reserve the right to make a deduction from the refund corresponding to the reduction in value compared to the original value of the product in the event that the product has been used or is damaged. 

4.2 The right of withdrawal does not apply in the event of:

  • Products that have been sealed for health or hygiene reasons and where the seal has been broken by you.

  • Products that have the nature of a sealed sound or image recording and where the seal has been broken by you.

  • A specially manufactured product that has been customised specifically for you or has a distinct personal character in accordance with your wishes.

  • Services that have been completed and where you have expressly consented to the commencement of the service without a right of withdrawal.

  • Goods that may quickly deteriorate, such as food.

  • Single issues of newspapers or magazines.

5. Complaints and disputes

  • We inspect all products before they are dispatched to you. But in the event that a product has been damaged or incorrectly dispatched when it arrives, we undertake, in accordance with current Swedish consumer protection legislation, to rectify the fault free of charge.

  • You must always contact us for approval before returning a defective item.

  • The complaint should be sent immediately upon discovery of the defect. 

5.1 How do you make a complaint?

Any faults or defects should always be reported to order@daylight.se, quoting your name, address, email address, order number and a description of the problem.

  • If we fail to rectify the fault or deliver a similar product, we will refund you for the defective product in accordance with current consumer protection legislation. If a complaint is approved, we will be responsible for the cost of return delivery.

  • We reserve the right to reject a complaint if it turns out that the product is not faulty in accordance with current Swedish consumer protection legislation. In the event of complaints, we follow the guidelines of the Swedish National Board for Consumer Disputes, see arn.se.

6. Limitation of liability

  • We accept no liability for indirect damage that may arise as a result of the product.

  • We accept no liability for delays/faults arising from circumstances beyond the company’s control (Force Majeure). These circumstances may be, for example, labour conflict, fire, war, government decisions, reduced or missing delivery from the supplier.

  • Furthermore, no liability is accepted for any changes to products/product properties that have been modified by the supplier in question and other factors beyond our control.

7. Product information

  • We reserve the right to make printing errors on this website and to sell out of products. We do not guarantee that the images reflect the exact appearance of the products, as some colour difference may occur, depending on the screen, photo quality and resolution. We always try our best to display the products as accurately as possible.

8. Information about cookies

  • In accordance with the Swedish Electronic Communications Act, for the purpose of privacy visitors to a website must be informed about the use of cookies. The information in the cookie can be used to monitor a user’s browsing. A cookie is a small text file that the website you are visiting asks to save on your computer in order to provide access to various functions. 9. Personal data

  • By purchasing products in the ESSVE fanshop, you accept ESSVE’s/Pålsson Daylights AB’s data protection policy and our processing of your personal data. We protect your privacy and do not collect any more data than is necessary in order to process your order. We never sell or disclose your data to third parties without a legal basis.

  • ESSVE/Pålsson Daylight AB is responsible for the processing of personal data that you have provided to us as a customer. Your personal data is processed by us in order to manage your order and in cases where you have requested newsletters or promotional offers – in order to be able to adapt marketing to meet your individual needs.

  • The information below is a summary of how we store and process your data in accordance with the General Data Protection Regulation (GDPR).

9.1 What is personal data?
Personal data is any information that can be directly or indirectly attributed to a natural person.

9.2 What data do we store?
In order to be able to process your order and answer questions relating to your order (customer service), we store your first name and last name, address, phone number, email address, IP address and purchase history.

  • Your data is stored for as long as we have a legal basis to process your data, for example to fulfil the agreement between us or to comply with a legal obligation, for example under the Swedish Accounting Act.

9.3 Legal basis
In connection with a purchase, your personal data is processed in order to fulfil the agreement with you.
Marketing, campaigns and similar mailings take place with your consent.

9.4 What data is shared and for what purpose?

9.4.1 Payment provider
When a purchase is executed, information is shared with our payment provider. The data stored comprises first name, last name, address, email address and phone number. If you choose to pay by invoice, your personal ID number will also be saved by the payment provider. This information is saved so that the purchase can be executed and to protect the parties from fraud. 
The payment providers (payment services) we use are: Swish, card purchases

9.4.2 Transport company
To be able to deliver your orders and fulfil our agreement, we need to share specific information with the transport company. The data shared with the transport company consists of first name, last name and address details for delivery. Email address and/or mobile number may also be shared with the transport company for notification purposes.
The transport companies we collaborate with are: DHL and the national postal service

9.5 Right to access
You have the right to obtain extracts of all the information we hold about you. Extracts are delivered electronically in a readable format.

9.6 Right to rectification 
You have the right to ask us to update incorrect information or to supplement information that is inadequate. 

9.7 The right to be forgotten.
You can request that data relating to you be erased at any time. There are a small number of exceptions to the right to erasure, e.g. if data must be retained in order for us to fulfil a legal obligation (e.g. under the Swedish Accounting Act).

9.8 Responsibility for data protection
Pålsson Daylight AB is responsible for the storage and processing of personal data in the web shop and makes sure that the rules are observed. 

9.9 How we protect your personal data
We use industry standards, such as SSL/TLS and one-way hash algorithms, to securely store, process and communicate sensitive information, such as personal data and passwords.

10. Changes to the General Terms and Conditions

  • We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be published online on the website. The amended terms and conditions are deemed to be accepted in connection with orders or visits to the website.

11. Disputes and jurisdiction

  • In the event that disputes cannot be amicably resolved between the company’s customer service and the customer, as a customer you can contact the Swedish National Board for Consumer Disputes (ARN), see arn.se. For residents of an EU country other than Sweden, complaints can be lodged online via the European Commission’s dispute mediation platform, see http://ec.europa.eu/consumers/odr

  • In the event of a dispute, we follow the decisions of ARN or an equivalent dispute resolution body.

  • Disputes concerning the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish law.
